In the UK 100s of businesses can all use the same name. No-one trade marks it only the very large companies such as Mcds etc.
Just choose another name.

I am soon setting up a clothing line but someone has recently taken the same name i was going to use.
From what i can see, they have not trade marked their company name.
Can i trade mark the name and then use it even though they have technically started using the name 6months before me?
