When you buy a car on credit, almost always your loan is with a different company. You buy the car from AAA dealership, and you get a loan from BBB lending institution. The lending institution may even have the same name as the auto manufacturer, but it's a different company. That means you're engaged in two different transactions with two different companies.

Unless you're paying the dealer directly (you could walk in and pay cash to make a payment), it will do you no good to hold the payment. It's not the dealer who repossesses the car, it's the finance company. The dealer has already been paid, so you're not putting any pressure on them by not making your car payments. The finance company doesn't care what problems you might have with the dealership, nor should they. All they know is you borrowed $XXX from them and your car is collateral if you don't pay.

You need to make your car payments, and you need to find a way to get the dealer to fulfil their end of the bargain. If you can't make any progress speaking with them yourself, check with your state attorney general's office. Some states have consumer mediation services available.

Don't go in and start making threats. That never works.

Fixing the car and repaying the car loan are two completely separate business dealings. You need to pay your car loan to whomever holds the note, and deal separately with the dealership about the repairs. If the dealership doesn't hold the loan note, they can't repossess the car because they have no ownership interest in it.

Yes they can repo the car if payments are not made. the fact that they are not living up to their side of the contract, does not relieve you from living up to your side of the contract (making payments). did you make sure that they were put in the contract that they were going to fix the ac and tires before you signed the contract? if the contract doesnt say that in writing, you might be SOL on them fixing it for free.

i owe them 550 more on a payment... but im making payments through the auto finance place. ive been telling the dealership for twomonths now that they need to replace the bald tires & fix the a/c (which they agreed to doing so) but they havent got to it...im not going to pay the rest of what i owe until they fix what they need to... & now they are saying they will repo the car..can they do that?

im about to make my 2nd car payment which is through the auto finance bank & they have no idea ive been making payments to them.
