That's a "value-added reseller." Make sure there is also insurance coverage for the specific risks of copyright, trademark and patent infringement. Technically, you're also a "retailer" if you sell your products to consumers rather than to other distributors or wholesalers. You didn't say who your customers are.

Some retailers do, in fact, repackage goods (e.g., building gift baskets or other "kits" for their customers), but that's not what makes them retailers.

I'm no legal expert, but I'd call you a retailer since you aren't actually producing goods.

I'm in the process of a start-up who's repackaging other brand name products into different size packaging. I am also giving the manufacture all credit including their trademark, nutritional information, allergy information, and list of ingredients (I am aware of the trademark infringement risks associated with repackaging) .

I am in the process of purchasing insurance, and I can't quite distinguish myself into a category. Am I a manufacturer, a retailer, or what?

The reason why I think I'm a manufacturer is because I'm handling the product and changing the packaging on it and resealing it, but I'm not changing the actual content of the product or creating anything new. I'm leaning towards being a retailer, but then I again, I don't believe retailers repackage the actual goods.
