If the person paying your husband is not with holding taxes, they must consider him a contractor and not an employee. You and he are responsible for paying the taxes on his earnings (Be sure you set some money aside). Not sure how you can explain this to a lender and still sound financially competent.
If he has been self employed for more than a couple of years the tax returns should be used. He may have lied and told them he had a job so they may not want to deal with him but he can start over with another bank using the truth.
something is seriously wrong if his "employer" is not withholding taxes or giving hem paystubs. sounds like your husb is being treated as an independent contractor and he needs to be declaring his income on a schedule C and SE with his 1040. if he is not doing that, you can forget about getting a mortgage and it will be hard even if he IS doing it properly for less than 2 years

The country determines the language - so all that can be deduced is you live in an English speaking country - we do not know the law as we do not know the country.
