When an item is not received yes the seller is obligated to give you a refund. Open an item not received dispute. So long as the tracking does not show as delivered they have no choice.
What does the tracking number indicate where the package is?
If phone is located in another country it could take 2 weeks. You go by the shipping date on the listing. Was your address correct in the Order Details?
Open a claim for Item Not Received.
If you never received the purchase, then it's technically still the property of the seller, who should have insured it so they could refund the amount you paid for goods not received.
Even if it says "delivered", there is a chance that it was stolen before it was ever in your possession, still not your problem.
You would have to read the merchants policy on the matter.
