The person contacted me on friday saying they are going to paypal to open a dispute for a refund because they wanted the dress for that same friday. If the person let me know they wanted it earlier I would have changed the postage price. For 1-3days delivery instead of 3-5 but they didnt contact me.
My question is, would paypal refund them due to that reason and if they could is there a way I can prevent them such as taking out the money in my account until the dispute has ended. If I do that is there any implications that may follow?
I know it is in the early hours but your question seems far from clear to me, first you talk about a TeeShirt then it changes to a Dress. It is not clear just which Friday the buyer wanted it for. If we assume that it was for the Friday after winning i do not see that they have a case. You posted on the Monday which is reasonable enough. Your listing would have stated that the basic p&p had an estimated delivery of 3-5 days. You have no control over it once the Post Office has got it and unless the buyer specifically told you that they needed it by the Friday after the sale [so giving you a chance to offer a quicker delivery method] then they really have no case for a return. ebay to tend to favour the buyer but i think in this instance they have no case and ebay would find in your favour.
They won the auction on Friday, and wanted the item on the same day, That's not going to happen. EBay and PayPal suggest to allow up to 45 days for item to arrive. That is accounting unexpected delays from the couriers.
Something is not clear on the time frames. Regardless if you shipped the next business day, not counting the weekends, your are good, as long as you have tracking. They don't have a case against you.
There is no shipping issue on your part unless you changed the buyers "preferred" shipping options-if you changed their shipping items and their not happy with the transaction--then you have to give them a refund on return of item. If you did in fact change shipping option the buyer selected and caused a problem with the buyer in some way--it would probably be the right thing to do --to give item to buyer with a refund to make up for the mistake-but you don't have to.
Pay pal generally favors the buyer. However, if you met all the requirements you stated in your listing, you might have a case. Did you ship immediately? Did you ship using the method that you promised in your listing? Did you use a tracking number? Even if you did everything right and win your case with Paypal, the buyer can still give you a bad rating and make you look like a bad seller for awhile. The impact of the bad rating will lessen over time if you get a lot of good ratings afterwards.
Just explain to paypal what happened, there is a good chance they will side with you. If not, the buyer will have to return the tshirt at his cost and you'll have to refund his money less your shipping costs.
If the estimated delivery was 3-5 days then your okay but less then no I don't think he can get a refund as delivering it a little late is not a good reason unless he lies and says something else
