Should i pay the fee?

That is a pretty hefty fee; must have been an expensive item.

What they are saying is that they pulled this item out of inventory and would not sell it to anyone else. They are asking to be compensated for these lost sale opportunities. This is not an uncommon practice.

I'm assuming you have stopped payment on the check your bank issued via bill pay. If not, and that check eventually shows up, they may deposit it and it will be deducted from your account. Then you will have a mess to straighten out with the vendor.

Since you have decided to not stop this first check and send another and just want to cancel the transaction entirely, ethically you owe the restocking fee. But I'm thinking they will not go to the trouble of pursuing you for this; you may just not be able to ever order from them.

To add: the money was never received, so therefore the product was never reserved. So you tell me what costed them $104? I understand they may have missed business due the payment situation. But they had listed that if your down payment is not received in a certain time, you would lose the product. So why didn't they just sell it if they did not get it in time. i feel forced into paying and that it is my fault?

Yes

Yes, of course.
