Let's say a person gets laid off from work and his last day of work is on a Friday. Let's also say he gets paid weekly and payday is on a Friday. The following Monday his layoff begins. During that week he gets paid his last paycheck-from the hours he worked before. He has never been laid off before and so must have to open a new claim and have a waiting week before he gets unemployment benefits. Would that first week count as a waiting week even if he was paid from his work for work he did the prior week? Or would the second week he has been laid off be considered the waiting week. I would think it would be the first one since he did not do any work during the first week he has been laid off. Asking for a friend who I think is getting the run around. Nothing much about this on the labor site.

Idk, just guessing but immediately when a person gets a notice from their employer no matter what it is I'd say first they should go to sign up for food stamps, and should sign up for unemployment comp...like go stand in line to fill out the application. When you get to talk to a counselor you'd know if you were there timely or not, or whether you've worked enough quarters to get it. But don't let other people tell you what is and isn't, go there and get the word straight from the mouth of the government.

you would file for UI benefits on the Mon that is the 1st day of not working ; that week will be the week that EDD will hold back, BUT when you get your first claim form from EDD, you will have to claim the money you were paid, no matter when it was received by you...example - your last day of work, Fri was on the 1st ;

Mon the 4th you file for UI benefits ; you receive final paycheck on the 7th ; your EDD claim form would arrive approx the 22nd ; you would claim the $$ from the last pay on that claim form ; your UI benefits would be zero for the week of the 4th to the 10th ( the holding week ) AND whatever your last pay was will be deducted from the UI benefits til it's all accounted for.................if you have Q's, message me
