So I filed an LLC in NJ. I did the research but it wasn't enough. Should I refile the LLC in Delaware or Nevada because of the advantages they provide. Regardless I need the new record to show that I started the LLC earlier this year (when it was originally filed).
Thoughts and help? Thank you in advance.
Wayne Z is right. Also, the process is that you would dissolve the LLC in the original state and refile in the new state. You would have the documentation showing the dissolution and reincorporation should there be any question about the chain of ownership, but the new LLC could not use the old LLC's initial date of incorporation in the new state records.
if you registered your LLC, regardless of where you did it it is of no value at all to register again, you have only ONE EIN and registering again will not change that
the point is you may register in Nev or Del for a very low fee but you will pay monthly fees to maintain the LLC in that state at the same time you will be subject to the taxes of the state you are operating in, you will have to register in that state as well so, ultimately you haven't saved much by registering in Nev. and/or Del
If you are operating in NJ, having an LLC registered in NV or DE, isn't going to save you a dime in taxes. You would still owe NJ income taxes on your NJ income regardless of where the company is registered.
For most small companies, it makes sense just to register in your home state.
Thank you all. I appreciate it. Looks like I'll stay put.
