Can a company legally dock your pay?

Where I work, if someone forgets their time card they simply fill out a form, stick it in the managers mail box with their clock in and clock out time. The manager then adds the hours to the computer system. However, they recently put a sign up today that says "If you continually forget to clock in and out, you will be docked hours."

To me this sounds illegal. I was just wondering if they can legally dock employees hours, since they are there and working.

No employees must be paid for time worked. Employees can be disciplined for not following the policy of clocking in, but the the employee must be paid for time worked.

Yes, they have to legally pay you for the time you worked. They can terminate you for misconduct for continuous failure to comply with company time keeping policy.

Companies have to pay you for time that you worked. However, the point of clocking in and out is that there is proof that you were there and working so they can pay you for it. If you keep forgetting to clock in, the company has no way to know whether you were at home or at work. So in essence, they don't have to pay you because you weren't working! Companies don't want to do this so they will often have you fill out a card and get it approved a manager can vouch that you were in fact at work. However, companies don't have to do this so if you don't clock in, there is no way to prove that you worked. The end result it, try to remember to clock in!

Sounds like if someone habitually forgets to clock in and out...then the employer is going to say, in essence, "Fine, you're only going to get paid for those hours you actually did clock in and clock out." It will definitely go a long way in making the employees RESPONSIBLE to consistently clock in and clock out as they're expected to do... Just sayin'

yes, they are actually being very lenient and bending over backwards to help you. If you don't clock in and out they don't have to pay you AT ALL as you have no proof that you were ever there.

They can delay your.pay not dock it altogether.
